By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy and consent to the practices described herein.

Information We May Collect About You

We collect and use different types of data from and about you, including:

  • Account information, such as your name, email address, date of birth, gender, location, username, and selected traits or preferences you choose to provide, including information reflected in features such as “What I Bring” and “What I Need,” as well as account settings, preferences, and visibility or discovery options.

  • Profile content, including photos, “About Me” descriptions, values, interests, and other optional details you choose to share as part of your profile.

  • Messages and communications, including conversations with other users and communications with us through the Service. Messages are not stored on an ongoing basis unless they are flagged, reported, or otherwise submitted for safety, moderation, legal compliance, or enforcement purposes. We may also collect contextual information related to reported or flagged interactions.

  • Gardener Conversations. If you choose to interact with The Gardener, Harvest’s optional virtual dating coach, we may temporarily process limited information you provide through those interactions. Conversations with The Gardener are ephemeral and are deleted permanently within twenty four hours. Harvest does not retain, reuse, or analyze Gardener conversations beyond the temporary processing required to provide the feature. If you choose to invite The Gardener to review a match, message, or interaction, only the specific context you select is temporarily processed and then discarded.

  • Verification and safety-related information, such as age or date-of-birth confirmations, account verification signals, reports, complaints, or information submitted by users relating to compliance with our community guidelines or safety policies.

  • User preferences and settings, including matching preferences, communication preferences, notification settings, and other choices you make within the Service.

  • Support and feedback information, including information you provide when you contact customer support, submit help requests, provide feedback, or respond to surveys.

  • Purchase and subscription information, including information related to in-app purchases or subscriptions. Payment transactions are processed securely by the Apple App Store or Google Play, as applicable. Harvest does not store your credit card or payment card information.

  • Non-personal data that does not directly or indirectly reveal your identity or directly relate to an identified individual, such as demographic information, statistics, or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal data. For example, we may aggregate personal data to calculate the percentage of users accessing a specific feature of the Service.

  • Technical and device information, including the full or partial Internet Protocol (IP) address used to connect your device to the Internet; login information; browser type and version; time zone setting; browser plug-in types and versions; operating system and platform; mobile device identifiers, device type and model, mobile operating system, application version, language preferences, and network or carrier information.

  • Usage and interaction data, including information about how you access and use the Service. For website use, this may include full Uniform Resource Locators (URLs), clickstream information to, though, and from our Website (including date and time), pages or features viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to navigate away from the page. For mobile app use, this may include in-app interactions, feature usage, session duration, interaction timestamps, referral sources, crash reports, performance logs, and diagnostic data.

  • Location-related data, such as approximate location derived from IP address or device settings. More precise location information is collected only where enabled by you or permitted by applicable law.

  • Device and Usage Information. We may collect information about the device you use to access the Service and how you interact with it, such as your IP address, device type, operating system, App version, crash logs, and limited usage data. We use this information to operate, maintain, secure, and improve the performance, reliability, and safety of the Service.

If we combine or connect non-personal, demographic, technical, or device data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal data.

How We Collect Data About You

We use different methods to collect data from and about you including through:

  • Direct interactions. You may give us information about you by filling in forms or by corresponding with us by phone, email, in-app communications, or otherwise. This includes information you provide when you create an account, subscribe to or use the Service, complete or update your profile, interact with other users, participate in features, promotions, or surveys, contact customer support, or when you report a problem with the Service.

  • Message Screening, Reporting, and Moderation. Outgoing messages may be automatically scanned using automated tools to help detect prohibited content and may be paused or blocked before delivery. Harvest does not read or store private messages by default. If a message or user is reported, or if content is flagged for potential policy violations, Harvest may temporarily access the relevant message content to investigate and address the report. Reported or flagged messages are retained only for as long as reasonably necessary to resolve the issue or to comply with applicable legal obligations.

  • Automated technologies or interactions. As you interact with our Website or mobile application, we may automatically collect technical data about your device, usage, interactions, and activity patterns, as specified above. We collect this information by using cookies, mobile SDKs, server logs, and other similar technologies (see Cookies and Automatic Data Collection Technologies below).

Some automated collection may occur through algorithmic or AI-supported systems that observe interaction patterns, activity signals, or contextual information generated through your use of the Service.

  • Third parties or publicly available sources. We may receive information about you from third parties, including, for example, business partners, subcontractors providing technical, moderation, payment, or delivery services, mobile platform providers (such as Apple or Google), advertising networks, analytics providers, search information providers, or publicly available sources, where permitted by law.

  • User contributions. You also may provide information for us to publish or display (“post”) or transmit to other Service users or third parties (collectively, “User Contributions”). You submit User Contributions for posting and transmission to others at your own risk. Although you may set certain privacy or visibility settings through your account, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of any Service users with whom you choose to share your User Contributions. Therefore, we cannot and do not guarantee that unauthorized persons will not view your User Contributions.

Our Website and mobile application use cookies (small files placed on your device) and other automatic data collection technologies to distinguish you from other users. This helps us deliver a better and more personalized Service and allows us to improve the Service by enabling us to:

  • Support safety, trust, and community standards, including by using automated tools to screen profile photos for compliance with our photo standards, such as clear face visibility and the prohibition of weapons, explicit imagery, or other prohibited content.

  • Support safety and respectful interactions by using automated tools to screen outgoing messages in real time for potentially harmful or unsafe content, such as harassment, threats, hate speech, or explicit abuse, and to pause or block messages where appropriate.

  • Deliver and evaluate promotions for our own services, including presenting information about features, offerings, or updates that may be relevant or of interest to you.

  • Generate suggestions or recommendations, including compatibility signals, feature recommendations, or content suggestions, which may be supported by automated or AI-assisted systems, based on your activity and preferences.

We may also use personal data to contact you about our own products, services, features, or offerings that may be of interest to you. You may manage your communication preferences through your account settings or as otherwise described in Your Personal Data Use Choices.

We do not permit third parties to use your personal data for their own advertising purposes, and we do not sell your personal data.

We may use non-personal or aggregated data for any lawful business purpose, including analytics, research, and service improvement.

Artificial Intelligence and Automated Features

The Service may include features supported by automated systems and artificial intelligence (“AI”) designed to help operate, support, and improve the Service and user experience.

AI-supported features may assist with functions such as matching, content suggestions, safety and trust features, customer support, system performance, and other similar purposes. These features operate based on information you choose to provide and activity generated through your use of the Service.

AI-supported features are not human and do not provide professional advice. Outputs or suggestions generated through AI-supported features may be incomplete, inaccurate, or not appropriate in all situations. You are responsible for how you interpret and rely on any information or suggestions provided through the Service.

We use AI as a support tool, not as the sole basis for decisions that produce legal or similarly significant effects about you. In certain situations, human review or oversight may be involved, such as when responding to reports, enforcing our rules, or addressing safety concerns.

Information processed through AI-supported features is handled in accordance with this Privacy Policy. We may use third-party service providers to support AI functionality, and those providers are permitted to process personal data only on our behalf and subject to contractual confidentiality and security obligations.

Use of Third-Party AI Tools and Training Disclosure. To support certain AI-assisted features of the Service, Harvest uses third-party artificial intelligence tools and service providers. In connection with providing these features, limited user inputs, messages, preferences, or interaction context may be transmitted to such providers for processing to generate outputs on our behalf.

Depending on the third-party provider and the configuration in effect at the time of processing, such providers may retain and use submitted data to improve, train, or develop their AI models, subject to their own terms, data usage policies, and privacy practices. Harvest does not control how third-party AI providers use data once received.

Harvest takes reasonable steps to minimize the personal information included in AI-related inputs and does not intentionally submit sensitive personal information for AI model training. Where available, we configure third-party AI tools to limit or opt out of data use for training purposes; however, such controls may not be available for all providers or processing scenarios.

By using AI-assisted features of the Service, you acknowledge the processing of your inputs by third-party AI providers as described above.

Disclosure of Your Personal Data

Harvest does not sell your personal information, and we do not share personal information for cross-context behavioral advertising.

We may disclose your personal data to the following categories of recipients:

  • Members of our corporate group, meaning our subsidiaries, parent company, and affiliates, where applicable.

  • Service providers that help us operate the Service, such as companies that provide hosting, infrastructure, analytics, customer support tools, messaging systems, security services, payment processing, and technical support.
    This may also include third-party providers that supply automated or AI-supported tools used to help operate, support, protect, or improve the Service, such as tools that assist with matching, safety features, content review, customer support, system performance, or reliability.
    These service providers are permitted to use personal data only to perform services on our behalf and are required to protect it and keep it confidential.

  • Other users or recipients when you choose to share information. For example, when you send messages, share profile content, or use features that allow information to be transmitted to others, we disclose the information necessary to provide those features.

  • Third parties when you give us permission, or when you otherwise direct us to disclose your personal data.

  • Communications from Harvest. You may choose whether to receive promotional or informational communications from us about our own services, features, or updates. You may also opt out of promotional emails at any time by using the unsubscribe link included in those messages. Please note that even if you opt out of promotional communications, we may still send you non-promotional, service-related messages, such as account notices, security alerts, or important updates about the Service.

  • Cookies and Similar Technologies. You may be able to manage certain cookies or similar technologies through your browser or device settings. Please note that disabling some technologies may affect the availability or functionality of certain features of the Service.

If you remove content you have shared through the Service, such as profile information or messages, copies of that content may remain visible to others where it has already been shared, saved, cached, or stored by other users or systems. Our Terms of Service govern appropriate access to and use of information shared through the Service.

Certain U.S. states, including California, have enacted privacy laws that provide residents with specific rights regarding their personal data. These rights may include the ability to access, correct, delete, or limit the use of personal data, as well as the right to opt out of certain data practices, depending on applicable law.

We retain personal data only for as long as reasonably necessary to support the operation of the Service and the purposes described in this Privacy Policy.

  • Gardener Conversations are ephemeral and are deleted permanently within twenty four hours to support user privacy and confidentiality.

  • User Messages are not stored or reviewed by default and are accessed only if flagged by automated tools or reported by a user for safety or moderation purposes.

  • Reported or Flagged Messages are retained only for as long as reasonably necessary to investigate and resolve the report and to enforce our community standards.

Data Security

We take reasonable measures to help protect your personal data from loss, misuse, and unauthorized access, use, alteration, or disclosure. We use a combination of technical, administrative, and organizational safeguards designed to protect personal data based on its sensitivity and the nature of our operations.

Access to personal data is restricted to authorized personnel who require access to perform their job responsibilities, including moderation, safety, and support functions.

However, no system or method of transmission over the internet or through mobile applications is completely secure. While we strive to protect your personal data, we cannot guarantee its absolute security.

The security of your information also depends on you. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly if you believe your account has been compromised.

Children's Online Privacy

The Service is not directed to children, and we do not knowingly collect personal data from individuals under the age of 18. If we learn that we have inadvertently collected personal data from a minor, we will take steps to delete that information as soon as reasonably practicable.

Sale or Sharing of Personal Information

Harvest does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act.

Any marketing or promotional communications we send relate solely to Harvest’s own services and are not based on the sale or sharing of personal information with third parties.

Harvest does not knowingly sell or share the personal information of individuals under eighteen years of age.

Residents of Covered States may exercise any applicable privacy rights using the same methods described in this Privacy Notice for California residents.

We will respond to verifiable requests in accordance with applicable state law and within the timeframes required by applicable law, which may include an initial response period and, where permitted, an extension. If a state law provides the right to appeal a decision regarding a privacy rights request, you may submit an appeal by following the instructions provided in our response. We will review and respond to any appeal within the timeframe required by applicable law. 

No Targeted Advertising or Sale of Personal Information

As described above, Harvest does not sell personal information and does not engage in targeted advertising or cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws.

If our data practices change in the future in a way that triggers additional rights or obligations under state privacy laws, we will update this Privacy Notice accordingly.

How to Exercise Your Rights.

You may exercise your California privacy rights by submitting a request through the in-app privacy settings or by contacting us at support@dateharvest.com.

Before responding to your request, we will take reasonable steps to verify your identity, as required by applicable law. The verification process may vary depending on the nature of the request and the sensitivity of the information involved.

You may designate an authorized agent to submit a request on your behalf. If you do so, we may require proof that the agent is authorized to act for you, and we may also require you to verify your identity directly, as permitted under California law.

Authorized Agent Request

If you submit a request as an authorized agent on behalf of a consumer, we may require you to provide your contact information, proof of your authorization to act on the consumer’s behalf, and information sufficient to identify the consumer whose information is the subject of the request.

We may also require the consumer to verify their identity directly with us or to confirm that they have authorized you to submit the request, as permitted under applicable California law.

Opt-Out of Sale or Sharing and Limiting Sensitive Personal Information

Harvest does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined under California law. 

  • To Opt-Out of the Sale or Sharing of Your Personal Information. Because Harvest does not sell or share personal information for cross-context behavioral advertising, we do not offer a “Do Not Sell or Share My Personal Information” opt out at this time. If our practices change in the future in a way that constitutes a sale or sharing of personal information, we will update this Privacy Notice and provide any opt-out rights and methods required by law.

  • Limit Use of Sensitive Personal Information. Harvest does not use or disclose sensitive personal information for purposes that would require offering a right to limit its use under the CCPA. If our use of sensitive personal information changes in the future in a manner that requires a limitation right, we will update this Privacy Notice and provide any required methods to exercise that right.
